Quotes are valid for 14 days and become a contract when accepted in writing

We use staged payments. Invoices must be paid on time to avoid delays.

Any changes must be approved in writing and may affect price and timing.

  • Built based on visible site conditions

  • Drainage is critical and included as specified

  • Engineering or council approvals are the client’s responsibility unless stated

  • Boundary locations must be confirmed by the client

  • We are not responsible for neighbour disputes

Unexpected issues (rock, groundwater, access) may result in additional costs.

Weather, site access, and third parties can affect timelines.

We aim to resolve issues quickly and fairly. Formal processes are available if needed.

  • 1. Contract Formation

    Quotes become a legally binding agreement upon acceptance by the client, including acceptance via signature, email, or text message.

    2. Pricing & GST

    All prices are in Australian Dollars (AUD) and are subject to GST

    Quotes are valid for 14 days unless specified otherwise.

    3. Payment Terms

    Payments must be made in accordance with the agreed schedule, which may include:

    • Deposit (if applicable)

    • Progress payments

    • Final payment upon completion

    Invoices are due within the agreed trading terms (typically 7–14 days).

    4. Security of Payment

    Timber & More may issue payment claims under the
    Building and Construction Industry Security of Payment Act 2009 (SA).

    Where applicable, invoices will include the required notice to comply with this legislation.

    5. Variations

    Any variation to the agreed scope of works must be:

    • Approved in writing (including email or text), and

    • May result in additional costs and/or time extensions

    Fuel Price Adjustment

    Quotes includes a fuel allowance based on diesel pricing at the time of quoting, referenced from the Australian Institute of Petroleum South Australian retail diesel price.

    If diesel prices increase by more than 5% from the date of quote, Timber & More reserves the right to apply a proportional adjustment to the contract price.

    Any adjustment will:

    • Be calculated based on the percentage increase in fuel prices and estimated fuel usage

    • Be provided to the client with reasonable supporting evidence

    Fuel Usage Variations

    Where fuel usage materially increases due to:

    • Site conditions

    • Access limitations

    • Delays outside of Timber & More’s control

    Any additional costs will be treated as a variation.

    6. Late Payments & Default

    Overdue invoices may:

    • Accrue interest

    • Result in suspension of works

    • Be referred for debt recovery

    The client agrees to pay all reasonable costs associated with recovering outstanding amounts.

    7. Suspension of Works

    Timber & More reserves the right to suspend works if payments are not made as agreed.

    Any resulting delays and additional costs will be the responsibility of the client.

    8. Site Conditions

    This quote is based on visible site conditions at the time of inspection.

    Unforeseen conditions may result in additional costs, including but not limited to:

    • Rock or hard excavation

    • Groundwater

    • Buried services

    • Restricted access

    9. Access & Delays

    The client must provide safe and reasonable access to the site.

    Delays caused by weather, site conditions, or third parties may result in:

    • Adjustments to timelines

    • Additional costs

    10. Materials & Ownership

    All materials supplied remain the property of Timber & More until paid in full.

    11. Completion

    Minor defects or incomplete items do not prevent the requirement for final payment.

    Retaining Wall – Specific Terms

    12. Engineering & Design

    Unless explicitly stated in writing, Timber & More does not provide engineering design or certification.

    The client is responsible for:

    • Obtaining any required engineering

    • Ensuring compliance with relevant regulations

    Any engineering required after commencement will be treated as a variation.

    13. Structural Limitations

    Retaining walls are constructed based on visible site conditions only.

    Timber & More is not liable for issues arising from:

    • Unknown or unstable soil conditions

    • Ground movement or settlement

    • Additional loads applied after construction (e.g. vehicles, structures, stockpiling)

    • Changes to surrounding land

    14. Drainage

    Proper drainage is critical to retaining wall performance.

    • Standard drainage will be installed as outlined in the quote

    • Additional drainage required due to unforeseen conditions will be treated as a variation

    Timber & More is not responsible for:

    • Water runoff from neighbouring properties

    • Pre-existing drainage issues

    • Client-requested designs that limit effective drainage

    15. Boundaries & Placement

    The client is responsible for confirming all boundary locations prior to construction.

    Timber & More is not liable for:

    • Incorrect placement due to inaccurate boundary information

    • Costs associated with relocation or rectification

    16. Approvals & Compliance

    The client is responsible for obtaining any required:

    • Council approvals

    • Permits

    • Certifications

    Any delays or changes due to approval issues may result in additional costs.

    17. Warranty Limitations (Retaining Walls)

    No warranty applies where:

    • The structure is altered or modified after completion

    • Drainage systems are interfered with or not maintained

    • Loads exceed intended design

    • Engineering advice is not followed

    Fencing – Specific Terms

    18. Boundary Confirmation

    The client must confirm fence location prior to installation.

    A licensed surveyor is recommended where boundaries are unclear.

    Timber & More is not responsible for disputes arising from incorrect boundary placement.

    19. Neighbour Responsibility

    Where fencing is installed on a shared boundary:

    • The client is responsible for obtaining neighbour agreement where required

    • Timber & More is not involved in cost-sharing or boundary disputes

    20. Ground Conditions & Obstructions

    Removal of existing structures, footings, or obstructions not specified in the quote will be treated as a variation.

    Hard ground, rock, or concrete may incur additional charges.

    21. Alignment & Finish

    Fence alignment will follow practical installation lines based on site conditions.

    Minor variations in level, alignment, or gaps may occur due to:

    • Ground movement

    • Terrain

    • Existing structures

    22. Damage & External Factors

    Timber & More is not responsible for damage caused by:

    • Weather events (including wind, storms, and flooding)

    • Third parties (including neighbours, animals, or vehicles)

    • Soil movement or environmental conditions

    Disputes

    23. Dispute Resolution

    Disputes may be referred to adjudication under the
    Building and Construction Industry Security of Payment Act 2009 (SA)
    or to the
    South Australian Civil and Administrative Tribunal if required.

    General

    24. Limitation of Responsibility

    No responsibility is accepted for disputes between property owners relating to:

    • Boundaries

    • Drainage

    • Structures
